1. Scope
These Terms and Conditions apply to all orders placed by consumers and businesses through the FRONTEIRA Spirits online store, operated by K&V Mercantil GmbH, Gerbermühlstr. 45, 60594 Frankfurt am Main, Germany (“we”, “us”). 2. Conclusion of Contract
The product listings in our store are not a binding offer, but an invitation for you to place an order. By adding a product to your cart and completing the checkout process, you submit a binding offer to purchase. We accept your offer either by sending an order confirmation email or by shipping the goods. A contract is only formed once we have confirmed your order.
3. Prices and Shipping Costs
All prices shown are in Euro (EUR) and include statutory German VAT, unless stated otherwise at checkout for cross-border orders. Shipping costs are shown separately during checkout before you complete your order and depend on your delivery destination. Details are available on our Shipping page.
4. Payment
Available payment methods are shown at checkout. Payment is processed at the time the order is placed; your order will be shipped once payment has been successfully received. See our Payment page for details.
5. Delivery
We aim to process and ship orders within the timeframe stated at checkout and on our Shipping page. Delivery times are estimates and may vary due to circumstances outside our control (e.g. customs processing for international shipments). We currently ship within Germany, the European Union, and to a defined list of international destinations shown at checkout.
6. Retention of Title
The delivered goods remain our property until full payment has been received.
7. Right of Withdrawal
If you are a consumer, you have a statutory 14-day right of withdrawal from your purchase. Full details, including the withdrawal instructions and a model withdrawal form, are available on our Right of Withdrawal and Withdrawal Form pages.
8. Warranty and Liability
Statutory warranty rights (Gewährleistung) apply as provided under German law. If goods are defective, you are entitled to supplementary performance (repair or replacement) and, where applicable, to a price reduction, withdrawal from the contract, or damages, in accordance with §§ 434 ff. BGB. We are liable without limitation for damages arising from injury to life, body, or health, for intentional or grossly negligent breaches of duty, and under the German Product Liability Act (Produkthaftungsgesetz). For ordinary negligence, our liability is limited to foreseeable damages typical for this type of contract and to breaches of material contractual obligations (“cardinal obligations”). Any further liability is excluded.
9. Age Verification Requirement and Responsible Consumption
Our products contain alcohol and are only sold to individuals aged 18 or older. By placing an order, you confirm that you meet this minimum age requirement. We reserve the right to verify age at checkout and, depending on the carrier and destination, delivery may require an adult signature.
Cachaça is a distilled spirit; the exact alcohol content by volume (% ABV) for each product is stated on its product page and label. Please enjoy our products responsibly, never drink and drive, and do not consume alcohol if you are pregnant, may be pregnant, or are underage. 11. Online Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR), available at https://ec.europa.eu/consumers/odr/. We are not obliged and not generally willing to participate in dispute resolution proceedings before a consumer arbitration board.
12. Applicable Law and Jurisdiction
These Terms and all contracts concluded through this store are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law does not deprive you of any protection granted by mandatory provisions of the law of your country of habitual residence. For merchants, legal entities under public law, or special funds under public law, the place of jurisdiction is Frankfurt am Main, Germany.
13. Severability
Should individual provisions of these Terms be or become invalid, in whole or in part, this does not affect the validity of the remaining provisions.
Language versions: This page is also provided in German and Portuguese (Brazil). In case of any discrepancy between language versions, the German version shall prevail.
